Changing my daughters last name

I was never married to my daughters father. I thought we were going to be together so I gave her his last name. He abandoned her when she was 3 months old and now she is over 4yrs old. She is signing with an agent to do comercials and modeling. I would like her to have my name since I have sole custody of her and he has never tried to see her. Is it hard for me to change her name? I do not want to have to get his permission.

There are two ways to do it. First, you are free to use any name you want for her without going to court or getting anyone�s permission. If you want to change it formally you can file a simple petition in the superior court. You have to give the father notice of the petition but you don�t need his permission.
