Changing last name of minor

My Boyfriend and I want to change my sons last name to his, the absent father has been out of our lives for over 10yrs. Do I still have to get his permission to change my sons last name even though my son age 13 also wants to change?

Re: Changing last name of minor

To legally change your son's name will require the filing of a petition in court. You will also be required to notify the bio father and other family members.
