Legal Question in Family Law in California
Changing last name of minor
When my 4 year old son was born, his father did not want to be named on the birth certificate. Thus, I gave him my last name. His birth certificate names no one as the father. Last year his dad signed a volentary admission of paternity for the LA DA. I wish to change my son's name to his father's and add his father to the birth certificate. How do I go about that? I was told that because our son was over 3, his father would have to ''adopt'' him. Is this true?

If your husband has an order from a judge declaring that he is the father of the child you can forward a certified copy of the order to the dept of vital statistics and have the father added. You might be able to use the DA voluntary admission of paternity. If that doesnt work have him file a petition to establish paternity and ask the court for an order that requires the birth certificate to be changed to add the fathers name.
Call vital statistics and ask them the easiest way to get the name on. You may save time and money of going a formal route by just filling out some form with vital statistics.
