Changing Schools

Father and I have 50/50 Legal and physical custody. Split is supposed to be alternate 7 days and split holiday vacations. He does not take kids (8&10) on his regular weeks or for holidays. In past 84 days(encluding Thankgiving and their 3 week christmas break)he has only taken daughter total of 6 days and son total of 4 days. At start of this school year we inrolled children in school by his home so he would be able to care for them after school. He gets off work at 1:00 daily and I at 6:30. He has only picked children up from school 5 days this year it is a 45 to 1 hour drive each direction from our home to school.It is then a 2 hour commute to my office. I spend 5-6 hours a day driving between their school, my work and home and $300+ in gas. I sometimes have to make the trip more than once a day . I want to switch them back to their old school 3 blocks from my house. We have only been able to contact hime by phone once in the past 3 weeks. He refuses to agree to the change or to help with the transportation. What can I do? Do I need a legal or to change schools?

If he does not agree then you will need to file a motion with the court for modification of the child custody order to determine which school the children will go to. You should talk to a family law attorney to determine how your situation affects the child support. Good Luck, Pat McCrary
