Changing My Son's Last Name

My son is 3 years old. His father and I were officially divorced before his first b-day. I do not receive child support and I have sole custody of my son. His father never sees him and I do not know where he is at this point. I am changing my last name back to my maiden name and would like to change my son's name to my name as well. How do I start the process and do I stand a chance without anything written from his father?

Need to turn the matter over to the District Attorney. They will collect child support for you. easy way is to get the child medical or state aid. They will find him. The fact that the father has had no contact with your son in 3 years should give you a good chance of being successful in changing his last name.

The name change does not have to be an official legal change. You can unofficially, but legally, change his surname without going to court. His birth certificat would still have his father's surname. The longer he uses your surname the better chance you have of being successful.
