child abandament and custody

can i seek child abandament against a mother who is hardly ever home divorce not filed yet she disappears for days when im off work and when i do work she might show up if she does once i get home she leaves otherwise my son cares for my qlmost 3 yr old girl are my chances for custody any better under these conditions i also have a 17yr old girl in high school who wants 2 be with me i spend all my time with my girls when not working.ialso think she is on drugs and alcohol and maybe even cheating with all the time she spends away from home she does not sleep in the home no longer

Your statement of facts is confusing. The procedure, that would appear to fit your situation, would be to file a petition for dissolution of marriage and request sole legal and physical custody. At the time you file the petition for dissolution you should seek a court order removing her from the home. This would protect the home from being damaged by her when she learns of the dissolution proceeding.

As for your 17 year old daughter you provided no indication where she is living and why she is not living with you.
