How do I get my child back?

My wife and I moved to a European country about 2 years ago. We have since had trouble and I'm back in the states. Where do I file for custody to get my son back to the US? In the state where we lived before we left, or the state where I live now or do I have to file in Europe? There is a divorce case pending in the other country. I have been back in the US for about 8 months now.

If the child is in Europe...you need do the case there. You can also file something where you live now...but need to serve your ex-wife in europe. If you get an order from the court here...then it may help you get the custody in europe.

You need to hire an attorney and take this seriously. If there is a divoce case pending in the "other country" then that sounds like the right place to address the custody/visitation issues.
