Legal Question in Family Law in California

Child Care Expenses

My husband reimburses his ex-wife for 1/2 of the child care expenses she incurs for my stepson as a result of her employment. My stepson spends one week each month of the summer with his father in addition to alternating weekend visits. My husband will be incurring child care expenses for the time his son is with him as a result of his employment because we cannot be off for 3 weeks during the summer. Can he legally ask her for reimbursement of 1/2 of the expenses he incurs for those 3 weeks? Also, he would like to be able to deduct the child care expenses for tax purposes. What must they supply each other -- care provider SS#, tax id? Thank you.

Yes, he can ask. He can also go to court and seek a modification of the underlying order.

I suggest that your husband consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
