Legal Question in Family Law in California

child custody and absent parent

my boys'father who is in prison(violent offender)will be released soon and he will be wanting to see the boys but he has no parental rights,he is pushy, mean and many a time abusive to me,this is partly why has lost custody.he was non compliant to his stipulations.he never intended on doing the anger management nor could he stay out of trouble long enough to stay out of prison so had to give his rights up to do his time of 8 years.now the question is how can i protect my boys and myself from his abuse?he is not afraid to do anything and will go as far as killing someone to get whatever he wants.

If you don't have a restraining order, get one. He doesn't have any rights, so you don't have to give in to anything he requests. You don't have to open the door if he comes knocking.

If he is being released from prison he will be on parole. Contact his parole officer and ask that he be prohibited from coming within 300 yards of your home. Two go to court and obtain a domestic violence restraining order against him. Then be very diligent about reporting any violation. Also consider an alarm system for your home.
