child custody and abuse

my children's father & I have joint custody. My so recently told me that his father kicked him in the back & smackes him in the head, There are no marks. My son is afraid to go over there. What is the best step for me to take against this. cps was called before & went to his house . He wasn't there & there were no marks . so, nothing came of it.

Talk to a family law attorney in the county where your custody order is issued. It really depends upon the procedure of the local court. In San Diego County you could ask for a modification of the order and then request the Family Court Services interview the child. Other counties appoint a child custody evaluator. Obtain the opinion of someone who has handled at least 50 child custody hearings and is familiar with the court system in that county. Good Luck, Pat McCrary
