Legal Question in Family Law in California

Child custody - abuse

I found out that my children's father showed them nearly nude photos (a woman posing in her underwear), and told them that it was me. They are 8 and 10 years old. I am concerned about taking them back to his home. I don't know what to do. I have already notified CPS, but I don't know if I need to do something at court. I am considering an ex parte hearing to stop him from having them pending an evaluation. I am not sure how to proceed. Thank you.

Re: Child custody - abuse

You should consult with an attorney and discuss this matter more fully. If the pictures were as negative as yo have portrayed them you should take action to prevent further contact with the father.

Re: Child custody - abuse

I would wait for the CPS report, if you believe it was an emergency I would file for an ex parte request for an emergency screening.

A family law facilitator can help you with the child custody issues and helping with the paperwork.

As always please consult with a local attorney prior to taking any legal action

Good luck,
