Legal Question in Family Law in California
Please help child custody case turned for the worst.
My spouse is a non-offending parent who had shared legal custody with daughter who lives in California (we live in GA). The child�s mother lost custody of her due to her unstable life criminal record, & a pending child sexual abuse case from her spouse. The court placed both children in the temporary custody of Aunt. The last hearing the judge stated upon evaluation of our home & the physical exams of step-daughter husband would be granted sole custody. Today in court his daughter (7) said she did not want to leave her sister (4) based on the negative influence of their mother who violated the supervised visitation orders. Since his daughter was not willing to come without her sister they set a trial date for March 9th. I had no clue that they would base the determination on a 7 year old child who doesn�t understand what is in her best interest. What are the chances that they will not award custody to--name removed--husband? Should we be aware of anything leading up to then that we can prepare?

The court will consider the affect of removing the older child on her younger sibling.
