Legal Question in Family Law in California

child custody case

A woman I was with for 3 weeks got

pregnant. The baby is now 6 months

old. She has been denying me visits.

The case is due to go to court. I

received a call from her asking me to

meet with her lawyer to attempt

mediation instead of going to court.

My question is: is it ethical for her

attorney to meet with us for

mediation when the lawyer

represents her? For now, I have told

her that I wish to go to court as it

doesn't seem right that her lawyer

could be a mediator and represent

her.

Most likely she is referring to a settlement conference with her and her attorney. Her attorny cannot be both a mediator and her attorney, he can however help settle the case.
