Legal Question in Family Law in California

child custody in cases of one parent being mentally ill.

If a mother of a child disappears without a trace for time periods of several weeks, causing the father who has provided for her and the child inability to work and continue providing for the child, is that considered abandonment? secondly, if the same mother has been physically abusive towards the child, and your only evidence is an audio tape is that addmissable to a court of law? third, is if that same mother is failing to get herself help is there ways to force her to get the medical attention she needs?

Given the brief information you have provided, you need to file papers with the court to get temporary custody of the child.

You should talk to an attorney first to make sure you do this properly. The attorney should be able to discuss your facts with you and help you to determine whether you can handle the case yourself or whehter you need an attorney to help you.

Your question brings forth many questions. Does Abandonment relate to you or the child. Was the tape made with or without the mothers permission. Etc. I suggest you contact an attorney. If you are located in Southern California you may call me at 818-342-8020
