Legal Question in Family Law in California
child custody
My children are not comfortable spending time with their father, they are eight and eighteen months old. Neither of us have legal custody of the kids. The kids father has a temper and has thrown the baby while in her high chair into the wall. When I file for custody can I request suprivised visitation?

Re: child custody
In addition to what Mr. McCrary's reply you should be aware that you can be liable for failure to protect your children from this abuse. Potentially there could be criminal charges. Removal of the children from your custody by CPS is a very real possibility. Do not hesitate another day immediately file for a domestic violence restraining order. If you cannot afford an attorney, request assistance from the local domestic violence shelter or support organization.
Re: child custody
You should file immediately because right now both of you have equal rights to the children. Good Luck, Pat McCrary
