Child Custody

I have a CourtOrder for me and my ex for my 6yr Old Child Which States his Father is suppose to get him Every other Week in the Summer starting at 6pm on Friday til the following Friday at 6pm as well. When the Child is in school its Friday at 6pm til Sunday at 6pm. It has been Two months since the other half has seen and or called my child he has not became active in my childs Life. What do I do? Can I file a motion of court? Can I get a Custody Change? My son says my daddy doesnt want me etc? Please answer regarding this as well my ex put in no Spanking as well I fell a child should when needed get a spanking on the butt with hands only can i also change this since the Court Order is not in effect?

You don't always want to file an Order to Show Cause. Consult with an attorney to determine the steps that you should take.

Your zip code indicates that you reside in Santa Clara county. In that county the general rule is that there is no spanking. Therefore you should rethink your position regarding spanking.
