Child Custody

My daughter in Ohio died. Her husband and the father of one of her children left her about a year and half ago and moved to California to live with his mother. He now wants custody of his 16 yr old daughter, but she does not want to live with him. What rights does she have? She is living with me, her grandma and grandpa here in California. He is saying that he is coming to take her home with him. Can he force her to go with him?

The father's rights are easily preferred to yours, however, if he has not had much of a relationship with her, you may be able to file a guardianship action and prevent him taking her for the moment, but the dispute isn't a one-shot deal, there may be several court hearings which can continue to be an issue until she is 18.
