Child Custody

Can I fight for my kids being that they are under permanent order? I am the mother and the father has primary custody. We both have joint but father is primary. It has been this way for five years. My daughter is now nine and son going on thirteen. They both say they want to live with me and to do something about it. I have talked to their father to see what is in the best interest of our children. Father becomes hostile when subject is mentioned. During the case, the kids father argued he had his own place and the kids had a room but almost immediately after the case was won for him, he moved in with his mother, father, brother, wife, nephew of now eleven years old. Within this home, there are four bedrooms. One for the brother and wife, one for the mother and Father of my Ex husband, the ex husband has his room and all the kids share a room. My daughter says the uncle; brother of ex husband mistreats the kids and makes them cry. My daughter shares a room with cousin and my son; both boys. This is an extreme concern. I lost my primary custody because I lived with my mother at the time and had a suspended license. Now, I have my own place with room for them and license. What can I do? Please help a desperate mother...

You need to file a motion for a change of custody, and request that you become the primary custodial parent. Retaining an attorney to assist you in the change of custody motion.
