If the child is 9 and currently in foster care, Does an ''Aunt'' have the right to get child custody over the Father if the child decides not to go with him? if the current mother cannot gain custody at the moment?

The general rule is that the parents have the first right to custody. For a non parent to obtain custody there has to be showing of detriment to the child if the child is placed with a parent. There is some reason that the child is in foster care. Unless that reason has been resolved detriment still remains as issue. Consult with an attorney regarding the situation.
