Legal Question in Family Law in California

child custody

A friend currently has her son living with her since her ex dropped of their 9 yo. Because he cant get along with his new girlfriend. She wants written physical custody they currently have Joint with him having physical. He has agreed to give her written custody only if she signs a letter stating that she will not file for welfare . #1 Would that letter be enforceable? #2 What if she signs it and also writes under duress? This is not the first time he has just dropped this child off with her and then taken him back when she filed and legitamitaly needed welfare and welfare went after him for support. he let her enroll the child in the school where she lives using her address. Any help would be greatly appreciate

she doesnt need his permission. she needs to file an OSC for change of custody which will probably be granted.
