Child Custody
My husband has two children from a previous relationship and the mother went to prison. He gave permission to the maternal grandmother to go and pick the children up from from another stae where they gave her gaurdianship. She refused to give the children to him when she got back. She then began to receive public assitance on their behalf but continued to take checks from him and not report them. What can he do about this and what is the likelyhood of him receiving custody. He also can't understand how he is paying child support and his name isn't even on the youngest ones birth certificate. Please shed some light so we can know how to persue this.

If she received money form father and did not report it to the welfare office, she had committed welfare fraud and perjury. He should take the checks to the family support enforcement office and show them to the person in charge of his case. The least that will happen is that he will receive credit for these payments.
He should also file a petition to to terminate the guardianship.
