child custody

If my husband has both our kids at the time he serves me divorce papers,does he get to keep them until the hearing?

Unless there is a termporary custody order, you both have equal rights to the children. If you cannot agree then either of you can go to the judge ex-parte to get a temporary order. Good Luck, Pat McCrary
