Legal Question in Family Law in California
Child Custody Investigation not Evaluation
The judge has ordered for the mother and I to see the CCI for a partial Investigation. The mother has lost custody both physical and legal due to substantiated neglect and there is a second investigation on substantiated charges of physical abuse to our 5 year old daughter. The mother was diagnosed as manic depressive in 2006 she took meds for a little while then stopped. At the Investigation interview I know she is going to have an avalanche of character references and I know her family will try to make me look bad none of which is true by any means. Any advice on what I should bring to the Investigation? How much weight will my daughters interview have? She does not want to live with her mother at all.The little time she does spend with her mother, her mother is always threatening and intimidating our daughter not to tell anyone such as her psychologist or the upcoming Investigator the truth or to even cooperate. I fear that the mother might sway the Investigator because she can be very convincing..Any and all advice would be so helpful..

Re: Child Custody Investigation not Evaluation
You should act and live as you normally do. The evaluators can smell phoniness a mile away. If you are not genuine it would probably hurt your chances and make the evaluator dislike you. As the facts stand it appearas the mother is in bad shape and must climb herself out of a hole.
As always please consult an attorney prior to taking any legal action. Good luck.
