Child custody issue

I have a three month boy old and a 28 month old girl. My husband has a sexual offender criminal record. My question is would he be allowed to take the kids at any time alone if I were to leave him? I know going though court hearings and all that is a difficult procedure. And in cases of Fathers without a record eventually gain 50-50 custody. Would that eventually happen. This is a general question without going into details. Can you please give some advice.

They type of sexual conviction will have a direct affect on the custody issue. It is probable that he would have supervised visitations. What happens in the future is difficult to predict.
