Child Custody Jurisdiction

I fled Colorado (me and my daughter lived for 11 months) due to domestic abuse and my children (one child and I was pregnant 5 months at the time). I left to California because my family lives there. Because I can't file for divorce in Ca. since Colorado has jurisdiction for my daughter, I filed for divorce there. Now I have an open divorce case. My son was born in Ca. and is now a year old. Can Colorado assume or get jurisdiction of my son? I want his child custody case in California.

You can file in California. You might need to do a change of venue if there is an open case in Colorado. You should consult with an attorney regarding all the facts of your case.

You can get a change of venue and file in CA for divorce since you meet the residency requirements. You need to talk to an Attorney ASAP.
