Child Custody Justification?

I divorced father living in Oklahoma, my ex-wife and child are living in San Diego. We've been divorced for over six years and I seem my daughter during the summer and holidays; sometimes more. My wife and her ex-boyfriend, whom she has a child by, have gotten into legal trouble and have been bouncing around from home to home, all the while dragging my daughter from school to school. A private investigator working for a financial company informed me they were living in filth when he attempted to reposses stolen items. She has since left the guy, but now she is living with her aunt with, all three cramped up in a single bedroom. She does not have a job. In fact, she's been out of work since August; living off of child support and unemployment. Do I have justification for to file for child custody based of the unstable conditions?

You certainly have grounds to file for a modification of the order. The age of your daughter will make a difference. You should get an address and phone number for the investigator who witnessed the conditions.
