Legal Question in Family Law in California

child custody laws what are my rights

I would like to know what the parental rights are for child custody. Can a judge take away the right a parent has to disipline their child? What are the laws concerning the discipline of a child? If I have custody of my child and am being sued for custody what does the judge base his decision on when awarding custody? Do you have to have proof backing your evidence or can you just say anything and have it considered? Can legal action be taken by a family member who has been wrongfully accused of corporal punishment and other lesser types of punishment without any evidence?

Reply: child custody laws what are my rights

In a general sense, the legal issue is what is in the best interests of the minor child. Judges do have the authority to issue orders preventing the use or corporal punishment. Children have rights as well as parents.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
