Child Custody and leaving the county

I want to move to my mothers county (1 hour away) and go into a shelter but my husband says he will take kids away if I do. We are not legally married but I never filed anulment or custody. Is he right, can he legally take kids if im in a shelter or another county?

The answer to your question will depend upon the reason for your moving out of the county and into a shelter. If you are moving because of domestic violence then it is unlikely he would get custody. You should consult with an attorney before moving, unless there is domestic violence and your safety is at risk.
