Legal Question in Family Law in California

child custody and living arrangements

As a father of a 10yr old daughter who wants to live with me and not her mother would my wife have to leave our place of residence without taking our daughter w/her if I was the one who filed for divorce requesting full custody. I have no where to go, as I am from Texas and have absolutely no family in the state. My wifes own biological children have said they would rather be with me than her. I need to get away from my wife and I fear for the safety of my children, all of them. What steps do I need to take to insure that my spouse does not try to do things to me that may cause me to lose my job.

You need to contact an attorney and work out a plan to proceed with the separation. Depending upon the precise facts in your case you may be able to get a restraining order that she move out of the house and give you custody of the children. Be careful in your interaction with her as she may attempt to set you up.
