Child Custody

I am married, and I have a 4 month old daughter. On her birth certificate I didn't put who the father was.

Well I want to file for divorce, and I want full custody.

Should I file for custody first, or just all together with the divorce.

He is a smokes mirajuana and has an anger problem. He already is on probabtion for 3 yrs for domestic violence. Can I use that against him?

I just dont want this to be a prolonged trial. Since he isn't on the birth certificate, that means I don't have to serve him. Just get full custody?

I need help!

You should file for divorce and custody at the same time. If he agrees...it will not be prolong. You have to serve him with all the papers.

You would file for divorce, and then move forward with custody, etc.
