child custody and moving to a different state

My boyfriend and I have a 2 1/2 year old daughter together. He and I do not have a good relationship and he is verbally and emotionally abusive to me. I want to move back to the Chicago area and take my daughter with me. I am from that area and my family is there. My question is, can I legally do that? Since we are not married, what are my rights and what are his? He refuses to move and yells at me whenever I bring it up.

You both have rights as parents. The best way to deal with this is with court order, as it gives you protection from any threats he makes.

You should get father's written consent or permission of the court before moving the child from the state. There are many factors that the court must consider and if you are serious about moving you should retain an attorney who is experienced in custody and move-away cases. Good Luck, Pat McCrary
