Child Custody

What is a parents legal recourse when both parents are 50/50 visitation but one parent (mom) no longer has a home and the other parent (dad) has a home and now has the child 100% time except a few hours a week when the mom comes to see the child. This is going into the 2nd month. The mom is wanting child support for this 2nd month and also wanting to keep him in a school that takes the dad 45 minutes to take him to when there is a school around the corner. What can the Dad do to have custody and enroll him in the nearby school?

Dad should go to court for custody, ex parte, and to modify child support. I'm sorry for the mom who doesn't have a home, and it sounds like Dad is being flexible, but Dad needs to protect his interests and the interests of his son. Why should the child have to travel 45 minutes to get to school? Unless, of course, the situation is temporary and the child has been going to school at that school for a long period of time.
