Legal Question in Family Law in California

child custody for parents with records?

Not married, but father has an excellent job/benefits and mother is unemployed and on welfare. He has felonies and has been in jail 4 times in the las two years. 1 conviction of wet/recklace, 1 domestic violence (both misdemeanors). Mother has 2 misdemeanors from 2006 (vandalism;interferring with police work). Mother is in college, and is custodial parent through welfare. Who has a better chance of having full custody? Father just had another dui case dropped and is a known alcoholic but nothing proving this fact. Mother wants full custody to keep child safe.

I would use the evidence of the DUI's and crimes against the parent when you are requesting full custody. Bear in mind custody battles are long and take time to work out. So be prepared for a long process.

As always please consult with a local attorney prior to taking legal action. Good luck.
