Legal Question in Family Law in California

Child Custody

My ex has primary physical custody of our three children. He is in Sacramento County and I am in San Mateo County. Recenty the father gave up custody of our daughter and she is living with me and going to school in San Mateo County. According to the documents, she should still be going to school in Sacramento County. Can I file documents in the county I live in to change these arrangements like an Exparte? I need to do this as soon as possible so this does not cause problems. Also he is collecting financial aid for all 3 kids and he should not be able to do that.

Re: Child Custody

You should file an motion for a change of custody in the court that gave him custody. Also contact the Sacramento county welfare department and report this condition. Unless you do this you could be liable for repaying the county for the aid he has received.
