Child Custody
I received a summons to appear in court. My childs mother is trying to give primary custody to me. I don't want custody, because I don't feel it's in my childs best interest. We went to mediation and could not resolve the matter. We had an evaluation, and we are now waiting for his determination. Am I legally bound by the courts decision if they decide to give custody to me even though I don't want it. What recourse do I have if this occurs?

There are huge questions raised by your post. Among them: is this a family law court proceeding or a dependency or other type of court proceeding? Why do you think it is in the child's best interest to stay with a parent who for some reason does not want custody? Where will your children go if not with you under the circumstances of your case? You might want to repost with more details.
