Legal Question in Family Law in California
child custody
My ex and I son is12yrs.We both have jointcustody. My son said he want to live with me.His dad is married with 3 girls. They live in a 3 bedrm home. The girls share a rm together.my son has his own room.He says he has no privacy.I'm more involved in my sons school.I have had him in private for 6 yrs now,and now and then his dad will help out with expenses.I take son to all docs, dentist eye appts. his dad has him enrolled in baseball, and lets me know of schedules a day before which conflicts with my wk with my son.So if we have plans it has to be rearranged. His dad will pick him up on my wk 4 times a wk for practice and games and keep him out till 10p.m.he doesn't care about his school,my son sometimes comes home and stays up till midnt to finish projects. If he tells his Dad about he has alot of homework, his dad will get mad and say what you don't want to play baseball? so our son is scared to tell his dad anything. His report card was one c.his dad flipped. What do you expect when you push your child to hard for sports. Its summer,he has him in all stars and it is conflicting with our summer vacation.his dad got mad.where i live in Riv I heard judges cater more to men.ANy suggest on modifying and winning this case?

Re: child custody
family law courts "presumably" operate under the theory of "the best interests of the child" at issue. if you feel strongly that your child is not receiving such, you definitely should retain legal counsel to help you set up an OSC hearing to modify and/or amend the current child custody order to reflect what is in actuality in the best interest of your child. if you would like further assistance in this matter, feel free to email my office directly.
