child custody

my son w/ girl already pregant. lived w/us 2yrs. she went to jail asked us to watch baby while gone. we reared child as our own. mom out of jail doing her thing. we still have child. grandma now wants custody. does our caring for child over 3 yrs count for anything. she is part of our family.do we have any rights? child calls us gramdma and daddy and auntie.

To stabilize the life of the child you need to petition the court to appoint you and the child's guardian.

The courts will want the parents to actually parent the child if they are capable of doing so. As a grandparent you have very little legal rights.
