can my sons father gain custody of my son even though he has been in prison for drugs guns and unlawful sex with a person under 17

The answer would depend upon your personal circumstances. How long has he been out of prison and what is his life style no. While is prison record is a serious disadvantage to him, it does not insure he cannot get custody.
