Child custody and support
my boyfriend and I lived in Norwalk CA...but we split since the baby was 1 month old. I moved to san francisco ca with my mom. the baby is now 5 months old and I haven't worked since I got pregnant. THe father rarely asks about her nor have he made attempts to see her. When I visit S. Cal, I give him opportunities to see the baby but he chooses to go out with his friends instead.
Ive documented text, emails and phone conversations, where he doesn't ask about our daughter.
I want full legal custody but am afraid because I'm not working and he fights it, he'll will custody. My mom's helped me financially 100% and for the baby...
what's the best way to do this? have my mom file for custody or myself? and would I have to file a petition for removal from the state or something else...cause Norwalk and San Francisco is 6 hrs apart.

You should contact as attorney and discuss the matter. His lack of contact with the baby will weigh in your favor. Until father establishes paternity, by signing a certificate of paternity at the birth of the child or a court order, father has no paternal rights.
