Legal Question in Family Law in California
child custody and support
My husband shares 50/50 custody of his daughter we have moved 30 minutes away from the mother and we asked her to let us have the daughter during the school week.she still has not responded. the daughter goes to counsling and the cousler said we should go to court and ask for full legal and physical custody. we also pay the mother 275.00 a month in child support? if we go to court and ask for that would we still have to pay support if we win? and do you think we have achance at getting custody? the counsler said she would
write a letter to family court and tell them the same thing.

Re: child custody and support
If the child's counselor recommends a change in custody, it will probably happen, what other objective person could give a better evaluation. If custody changes, the child support changes. You should have an attorney for the motion to modify child custody, he can also tell you what to expect concerning child support. Good Luck, Pat McCrary
