Legal Question in Family Law in California

child custody

My wife and I have been separated for 2 � yrs, she told me about a year ago she had a temp job in Florida, and that she would be down there for about 6 months about three months ago I learned that she is staying, we have never had a custody hearing but she has are 11yr old daughter with her, is there any action I can take to get my child back?

You can go to court in your area and file an OSC for custody and requesting that she be ordered to bring your daughter back, but I don't know how well it will work.

Yes, of course you can. You can get visitation of your child, but I doubt the child will live with you full time. If the marriage is over, you can start by filing a dissolution of marriage and OSC in California so you won't have to travel to Florida for every court hearing.
