Legal Question in Family Law in California

Child Custody

I have an 8 yr. old grandson who is in CPS custody. The cps worker said I cannot get temporary custody because I recently got off probation and parole (1yr) I have an 18 yr. old who has no criminal record and she has her own place. The cps worker said she won't even consider it because of her age and she is not independent and he is on medication. I told her I would be helping her and she said absolutely not. I completed a 5-month drug program and have 2 yrs. clean. I have never had any cps cases and my criminal case is for check fraud. My other daughter is not trying to cooperate in doing what they are requiring of her to get her son back. I do not want to lose him to the system.

Re: Child Custody

This will be a difficult case. You should file a petition requesting that the placement of your grandchild be reconsidered, and your 18 year old daughter be considered. Your daughter will have to convince both the social worker and court that she is both willing be able to take of an 8 year old.
