Legal Question in Family Law in California

Child Custody/Adoption?..

I have my child 100% of the time, my child doesn't know his biological father at all because his biological father has never been there at all (we never married). But I do not have full custody award to me, he still has the other half (by law). I married and my husband has taken over the father position and thats the only father my son knows. Now my question is.. How can my husband be awarded the other half of the custody? Would he have to adopt my son so that he becomes (always has been) ''Our'' son and for my son to carry his last name.? This information will be greatly appriciated!! Thanks in advance..

You need to file for adoption and have the biological father consent to this adoption. You should ask whether he would like to allow your son to be adopted.
