Legal Question in Family Law in California

child custody/child support

My granddaughter is only 16 mos. old. My son and her mother are 22 and 17 yrs.old; They were living together, but parted in not very friendly terms a few weeks ago. My son found the baby's mom with another young man, they got into a fight and now Mom is filing for custody of the baby with restricted/ supervised visitation or no visitation at all if possible. She says my son is violent and has has fights with her in front of the baby. She told me she wants me to be the person supervising my son's visitation with the baby but I do not know if that would be beneficial for all of us concerned or not. These two kids are, inexperienced and immature. What can my son do to have joing custody with visitation and would I have to file for visitation also? I want to be able to continue helping bringing up the baby. Mom is in agreement with that. Also, how much will it cost my son to see an attorney and get some legal advise? I want what is best for the poor child in the middle of this mess.

Please repply if possible. Thank you very much. Mrs. Valle

I reccommend that your son hire an experienced family law lawyer to represent his interests. He will need orders for custody and visitation so that the mother will have to abide by them instead of doing whatever she wants to do on a given day. She should not be allowed to be a monitor!

His best chance of getting large amounts of time with his child is before the child starts school. Once the child starts school, parenting issues rotate around the school schedule.

Good luck to you!
