Legal Question in Family Law in California

Child custody/visitation

I want to know about applicable law or info regarding a biological parent seeking visitation with their children when the other biological parent is out of town. Does the biological parent get priority over a step-parent? Both parents have joint legal & physical custody. Is there some first right of refusal?

Re: Child custody/visitation

While a biological parent usually has preferential rights over a step-parent, the answer to your question depends on the visitation order. If the visitation order should be changed, you need to file a motion to change it.
