How old must a child be in order to decide his own visitation and/or custody?

The court in its discretion may determine the child's discernment to decide on visitation and/or his custody.However, you can support the child's discernment on surrounding circumstances and if it is favorable to you then by all means present it in court.

I had a case where the minor's counsel told the court that although the child was only 7, that he was smart and aware of what was going on and that his wishes should be taken into consideration. I think it depends on different factors as to whether the court will take the child's wishes into consideration.
