Legal Question in Family Law in California

child day care

Marital Settlement Agreement states that ''parties agree that they will equally share any child day care expenses incurred as a result of the parties employment''

If one of the parties (Mother) quits employment and goes to school full time for 9 months, does that give the party a right to continue to collect for day care? (the agreement does say employment not school)

Parties have joint legal and joint physical custody. Both children live with the Mother. Father has them every other weekend. I have until the 18th of June 2008 to get an answer, Please and Thank You !!!

Based upon the wording that you have given, daycare is for employment only. It would not include daycare for purposes of education, unless that education was required by the parents current employer. Good Luck, Pat McCrary
