Legal Question in Family Law in California
child evaluation
Ex was ordered supervisede vistation due to not knowing our son and past unstability, violance and PTSD. Only excerside this right 3 x's in last 4 yrs. I filed a restraining order in Dec due to constant threats and violance. I was awarded RO today and then my ex started crying and asked to sign away all rights of our son. Judge ordered a 31.11-evaluation on my new family and my ex. Do I have to do this evaluation? I have had our son from birth and have raised him for his whole life. I have never said anything negative about his biological Dad. I don't understand why this can be ordered when there is no alligations or rumors of an issue with me or my children? Why do I have to proove my innocence and compitant parenting? Can my ex sign away rights w/out me agreeing? If he does sign away rights does he still have to pay child support?

You must either do what the judge ordered or appeal the order.
