Legal Question in Family Law in California

child not exercising midweek visitation rights

For about a month and a half my son's father hasn't been picking up our son for his midweek visitation due to him moving out of the county. His mother who still lives in the area now wants to start picking up my son during her sons midweek visitation time. The court order does not state that my son's father has to be there to pick up our son nor does it state that I have to let him go with his mother or any other person.. Do I have to let my son go with his grandmother if she says she is picking him up for his dad? She has never picked him up before?

Re: child not exercising midweek visitation rights

I'd ask her the plans. Is she exercising visitation on behalf of her son? If so, I'd say no. If she's transporting your child to his father's house, I might allow that to happen. Do you have dad's new address and telephone number? Is grandma brining him back home? How old is your son?
