Legal Question in Family Law in California

My child father took me to court in 2008 for custody of our son, I was granted shared custody of our child. Mon. at 6:00pm to fri. 5:00pm. The problem is lately he has not been the one thats been keeping our son he would pick him up from me then drop him off with his mother and he wont have him for any of his time. So how should i go about changing the custody agreement and how can i prove it to the courts that he never has him on his days, and leave him with his mother that has a drug problem .

The way you go about changing custody because he is not actually spending time with the child, is to file a motion or OSC to modify the custody order. How you prove facts in court is both too specific to the situation, and to complex legally, to answer in an internet question. You can probably get some help with that from your local Family Law Facilitator in your county court.
